By accessing or using Thoughtmarks ("Service," "App," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

1.1 Eligibility

• Must be at least 13 years old
• Have the legal capacity to enter into binding contracts
• Not prohibited from using the Service under applicable laws
• Comply with all local laws regarding online conduct and acceptable content

1.2 Changes to Terms

We may modify these Terms at any time. We will notify you via:

• In-app notification
• Email to your registered address
• Prominent notice on our website

2. Account Creation and Security

2.1 Account Registration

Required Information:

• Valid email address
• Secure password (minimum 8 characters)
• Age confirmation (13+ years)

Optional Information:

• Display name
• Profile photo
• Timezone and language preferences

2.2 Your Responsibilities

• Maintain confidentiality of your account credentials
• Responsible for all activities under your account
• Notify us immediately of any unauthorized access
• Use a strong, unique password
• Enable two-factor authentication (strongly recommended)

2.3 Account Termination

By You: Delete your account anytime via Settings → Account → Delete Account. All data permanently deleted within 30 days.

By Us: We may suspend or terminate accounts for violations of these Terms, fraudulent activity, or security concerns. We provide 14 days' notice unless immediate action is required.

3. License and Ownership

3.1 Your Content Ownership

Your content includes:

• Thoughtmarks (notes, voice recordings, thoughts)
• Tags, labels, and organizational structures
• Any other data you create or upload

3.2 Limited License to Us

By using the Service, you grant us a limited license to:

• Store your content on our servers
• Process your content to provide features (search, AI, sync)
• Backup your content for recovery purposes
• Display your content to you across your devices

3.3 Thoughtmarks Intellectual Property

Thoughtmarks owns all rights to:

• The Thoughtmarks app, website, and services
• Thoughtmarks branding, logos, and trademarks
• Our proprietary AI models and algorithms
• Documentation, design, and user interface

4. Acceptable Use Policy

4.1 Permitted Uses

• ✅ Task management and productivity

4.2 Prohibited Activities

You agree NOT to:

• ❌ Attempt to gain unauthorized access to the Service

• ❌ Reverse engineer or extract source code
• ❌ Resell or redistribute the Service

5. Subscriptions and Payments

5.1 Free Tier

Thoughtmarks offers a free tier with core features:

• Unlimited Thoughtmarks
• Voice recording and transcription
• Basic search functionality
• Apple Watch integration

5.2 Premium Subscription

Premium features include:

• Advanced AI features (semantic search, insights)
• Cloud backup and sync
• Unlimited voice recording length
• Priority support

5.3 Billing

• Subscriptions billed monthly or annually
• Payment processed through Apple App Store
• Cancel anytime (billing ends at end of current period)
• No refunds for partial periods
• 14-day refund for EU customers

5.4 Price Changes

We may change subscription prices with 30 days' notice. Price changes apply to subsequent billing cycles. You may cancel if you don't accept the new price.

6. Disclaimers and Limitations

6.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties including:

• Merchantability and fitness for purpose
• Non-infringement
• Availability, reliability, or accuracy
• Error-free or secure operation

6.2 Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to amounts paid in the past 12 months
• We are not liable for loss of data, profits, or business opportunities
